Part I – Website Terms of Use and Sale
1. Scope and acceptance
These Terms govern access to and use of fairydalia.com (the “Website”) and purchases made through it. The Website is operated by Dalia Lane, an independent author and publisher using an established professional pen name (“Fairy Dalia”, “we”, “us” or “our”).
By using the Website, you agree to the provisions governing Website use. By placing an order, you also agree to the provisions governing sales. Mandatory consumer rights are not excluded or restricted.
Only a person legally capable of entering a binding contract may place an order. A parent or guardian who permits a minor to use the Website is responsible for supervision.
2. Contract documents and changes
- these Terms;
- the product description and price shown at checkout;
- the Privacy Notice and Cookie Notice;
- any product-specific licence, promotion, event or subscription terms; and
- the order confirmation and any individually agreed written terms.
The version in force when an order is placed governs that order. Future changes do not retrospectively reduce acquired rights.
3. Permitted Website use
You receive a limited, revocable, non-exclusive and non-transferable right to use the Website for lawful personal, family, educational and purchasing purposes.
You must not:
- use the Website unlawfully, fraudulently or in a way that infringes another person’s rights;
- interfere with security, introduce malware or attempt unauthorised access;
- scrape, harvest, index or systematically download content without written permission, except ordinary search-engine indexing;
- copy, republish, resell or commercially exploit Website content;
- impersonate another person or submit false order or payment information;
- transmit abusive, discriminatory, obscene, exploitative or harmful content; or
- remove rights notices or circumvent access or technical protection measures.
We may restrict access where reasonably necessary for security, maintenance, legal compliance or investigation of misuse.
4. Intellectual property
Unless stated otherwise, the Fairy Dalia stories, characters, fictional world, text, poems, illustrations owned by or licensed to us, logos, designs, photographs, audio, videos, educational materials, printables and Website content are protected by copyright and other intellectual property rights owned by or licensed to Dalia Lane.
The preferred public notice is: “Copyright © Dalia Lane. All rights reserved.”
You may not translate, adapt, dramatise, animate, record, publish, distribute, merchandise or create commercial derivative works without prior written permission.
5. Personal, classroom and library use
Purchased books may be read privately. A downloadable resource expressly identified as a classroom resource may be reproduced by one purchasing teacher for pupils taught directly by that teacher in one school or learning group.
The resource may not be posted publicly, shared across an institution, uploaded to a repository or resold unless a broader licence is purchased.
Libraries, schools and community organisations may conduct non-commercial, unrecorded readings from lawfully purchased physical books. Streaming, recording, broadcasting, commercial advertising and large ticketed events require written permission.
6. Artificial intelligence and text/data mining
Except where mandatory law expressly provides otherwise and the right cannot lawfully be reserved, Website and Fairy Dalia content may not be used to train, fine-tune, evaluate, ground, prompt, develop or improve an artificial intelligence or machine-learning system.
- No content may be included in a dataset, model, embedding database or retrieval system without permission.
- No person may use the content for character cloning, style imitation, synthetic narration, image generation, text/data mining or automated extraction.
- No AI-generated work may materially reproduce or imitate Fairy Dalia characters, stories, illustrations or distinctive creative expression.
- Technical and machine-readable rights reservations may not be circumvented.
7. Products, orders and contract formation
Product displays are invitations to place an order. You make an offer by submitting the checkout. An automated acknowledgement normally confirms receipt only. A contract is formed when we accept the order, dispatch the goods or supply the digital content.
We may reject an order before acceptance for legitimate reasons such as lack of stock, suspected fraud, payment failure, delivery restrictions or an obvious error. Amounts already collected will be refunded.
Customers must be able to review and correct checkout information before submitting the order.
8. Prices, taxes and payment
Prices are shown in the currency displayed at checkout and include Swiss VAT where applicable. International customers may owe import VAT, customs duties, carrier fees and local taxes.
Payment methods are displayed at checkout and may be supplied by third-party processors. We may carry out reasonable payment and fraud checks.
9. Physical delivery
Destinations, delivery methods, charges and estimates are shown at checkout. Estimates are not guaranteed unless a fixed date is expressly agreed.
Customers must provide a complete address. For consumers, risk remains with us until delivery to the customer or a designated third party, except where the customer independently commissions a carrier not offered by us.
Contact us promptly about delay, loss or damage, including the order number and photographs where appropriate.
10. Digital products
Ebooks, PDFs, audio, recordings, printables and other digital products are licensed, not sold, unless mandatory law states otherwise.
The purchaser receives a limited, non-exclusive and non-transferable licence for personal/family use or the expressly stated classroom use.
- Do not share files, download links or credentials.
- Do not upload files to public or shared drives, social platforms, marketplaces or repositories.
- Do not resell, sublicense, rent, lend or redistribute digital products.
- Do not remove watermarks, rights information or access controls.
- Do not use files for prohibited AI, mining or dataset purposes.
11. Withdrawal rights
Swiss law does not generally provide a statutory cooling-off right for ordinary online purchases. The voluntary return policy below is additional to rights concerning defective or misdescribed goods.
Where mandatory EU, EEA or UK law applies, eligible consumers generally have a 14-day withdrawal right for distance contracts. Exceptions may apply to personalised goods and to digital content supplied immediately after the consumer expressly requests immediate supply and acknowledges the resulting loss of the withdrawal right.
Where EU law requires an online withdrawal function, the Website must provide one.
12. Voluntary 30-day returns
Eligible physical products may be returned within 30 days after delivery if the customer contacts us within that period and returns the product unused, unread and resaleable, with appropriate packaging.
Unless the item is defective, damaged, misdescribed or incorrectly supplied, the customer pays return postage and original delivery charges are not refunded.
This voluntary policy excludes personalised or signed-to-order products, digital products, completed services and products damaged after delivery.
13. Defective or incorrect products
Contact us promptly with the order number, description and reasonable evidence. Remedies required by applicable law may include repair, replacement, price reduction, cancellation or refund. Mandatory warranty and consumer rights remain unaffected.
14. Reviews and submissions
A person submitting a review, artwork, photograph, story, testimonial or competition entry retains ownership but grants us a non-exclusive, worldwide, royalty-free licence to host, format, reproduce and display it for operating, promoting and documenting Fairy Dalia.
The submitter confirms they have all permissions. Identifiable information about a child may be submitted only by or with the informed authority of the child’s parent or legal guardian. We may remove, anonymise or decline content.
15. Children
The books and creative content may appeal to children, but the shop, account, newsletter, contact and submission functions are intended for adults, parents, guardians and educators.
Children must not order, subscribe, create accounts or submit personal information without appropriate adult involvement. We do not knowingly seek personal data directly from children under 13 without verifiable parental consent where required.
16. Educational and wellbeing disclaimer
Stories, mindfulness activities and educational resources are general literary and educational materials, not medical, psychological, psychiatric, therapeutic, legal or professional advice. Parents, guardians and educators remain responsible for suitability and supervision.
17. Third parties, availability and accessibility
Third-party payment, delivery, video, social media and retail services may have separate terms. Links do not imply control or endorsement.
The Website is provided on an available basis. We aim to make it reasonably accessible and invite users to report barriers at the contact email.
18. Liability
Nothing excludes liability for wilful misconduct, gross negligence, death or personal injury caused by negligence, fraud, mandatory product liability, mandatory consumer law or any liability that cannot lawfully be excluded.
Subject to that rule, we are not liable for indirect or unforeseeable consequential losses. Mandatory consumer remedies remain unaffected.
19. Events beyond reasonable control
We are not responsible for delay or failure caused by events beyond reasonable control, including natural disaster, epidemic, war, governmental action, carrier disruption, major outage, cyberattack or essential supplier failure. We will take reasonable mitigation steps and provide cancellation/refund where required by law.
20. Governing law and courts
These Terms are governed by substantive Swiss law, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.
The courts at the operator’s place of business have jurisdiction, subject to mandatory consumer jurisdiction rules. Consumers retain rights to sue in their domicile or habitual residence where mandatory law provides.
Part II – Privacy Notice
1. Controller and scope

This Notice describes processing through the Website, shop, newsletters, rights/permission requests, customer service and related communications.
2. Data collected
- contact and identity information supplied by adults, such as name, email, postal address and telephone number;
- order, payment status, delivery, returns and customer-service records;
- account and preference information, where accounts are offered;
- newsletter consent, subscription and interaction records;
- permission, review, artwork or event-submission information;
- technical data such as IP address, browser, device, timestamps, security logs and cookie identifiers; and
- communications and records needed to establish, exercise or defend legal claims.
3. Purposes and legal grounds
- to operate the Website and perform orders or requested services;
- to answer enquiries and administer returns, permissions and complaints;
- to comply with tax, accounting, consumer, sanctions and other legal obligations;
- to protect the Website, prevent fraud and enforce rights;
- to send marketing where consent or another lawful basis permits, with an unsubscribe option;
- to measure and improve the Website where permitted and subject to required cookie choices; and
- to establish, exercise or defend legal claims.
Where GDPR/UK GDPR applies, the grounds may include contract, legal obligation, legitimate interests and consent. Consent may be withdrawn without affecting earlier lawful processing.
4. Children’s information
The transactional and interactive functions are directed to adults. Do not submit a child’s full name, contact information, school, precise location, photograph, voice or artwork unless you are authorised and the stated use is appropriate.
Where a child-directed online service knowingly collects personal information from a child under 13 in circumstances covered by COPPA, verifiable parental notice and consent, access/deletion rights, security and retention controls must be implemented before collection.
5. Recipients and service providers
Data may be disclosed to hosting, ecommerce, payment, delivery, email, IT-security, analytics, professional-adviser and public-authority recipients only as reasonably necessary.
Service providers should be contractually required to protect data and use it only for authorised purposes.
6. International transfers
If data is transferred outside Switzerland, the EEA or UK, we use an adequacy decision, recognised framework, standard contractual clauses or another lawful safeguard as applicable.
7. Retention
We keep data only as long as necessary for the relevant purpose, including contract, tax, accounting, warranty, fraud prevention and limitation periods. Child-related submissions are reviewed and deleted or anonymised when no longer needed.
8. Rights
Depending on applicable law, individuals may request information/access, correction, deletion, restriction, portability, withdrawal of consent or objection. Requests may be sent to the contact email and may require identity verification.
A person may complain to the Swiss Federal Data Protection and Information Commissioner or another competent supervisory authority.
9. Security and breaches
We use proportionate technical and organisational measures. Where a breach is likely to create a high risk, we notify the competent authority and affected individuals where legally required.
10. Changes
We update the Notice when processing materially changes and state the effective date. We do not use a material new purpose without the notice or consent required by law.
Part III – Cookie Notice
Cookies and similar technologies may store or access information on a device.

- Strictly necessary: checkout, security, load balancing, consent records and essential preferences.
- Functional: optional language, media or convenience functions.
- Analytics: measurement of visits and performance.
- Advertising/social: cross-site tracking, targeted advertising, social-media pixels or embedded services.
2. Choices
Necessary technologies may operate without optional consent where legally permitted. Non-essential cookies must be blocked until valid consent is obtained where required. Users must be able to reject as easily as accept and later change their choices.
3. Browser and consent settings
Users may manage choices through the consent tool and browser settings. Blocking necessary cookies may prevent checkout or account functions. Withdrawal of consent does not affect earlier lawful processing.
